Allegedly, deft trucking company dropped metal debris on I-294, which disabled plaintiff’s car. Plaintiff was standing on the shoulder of the road when another motorist lost control while trying to avoid the debris and struck him. He sustained a traumatic brain injury (cognitive impairments, vision and swallowing problems, and wheelchair-dependency resulted) in addition to spinal fractures (T-11 and L-1) and a fractured right leg (femur, tibia, and fibula required ORIF). Plaintiff, male age 37, a part-time laborer, was hospitalized for treatment of pneumonia and severe alcohol withdrawal. Allegedly, hospital staff should have placed him in the ICU, and did not properly monitor him. As a result, he suffered respiratory arrest and severe brain damage. It was disputed whether the patient retained some degree of consciousness or was in a persistent vegetative state. Defendant’s van driver turned left in front of plaintiff’s motorcycle driver at Route 120 and Wilson Road, Round Lake Beach. Plaintiff, male age 42 suffered closed head injury causing memory loss, personality change, cognitive deficits and 50% vision loss in right eye, pelvis fracture with fixation, hand fracture, wrist fracture with fixation and two repair surgeries, and drop foot.
